A significant lottery contract lawsuit is unfolding, with a document dump blunder potentially giving an ex-porn baron the upper hand in a £200 million legal battle.
The case stems from the Commission’s decision to award the lucrative National Lottery contract to Czech operator Allwyn, which Desmond argues was neither fair nor transparent. Desmond’s company, Northern & Shell, was a losing bidder for the lottery concession, one of the UK’s biggest public contracts.
Richard Desmond, who founded OK! Magazine and has owned The Daily Express and the UK’s Channel 5, has also been involved in the adult publishing industry.
‘Unprecedented Blunder’
It’s standard practice for opposing parties to exchange relevant information before trial, known as pretrial disclosure. However, a law firm representing the UKGC mistakenly shared over 4,321 documents containing privileged information with Desmond’s legal team.
Judge Nerys Jefford termed this incident an “unprecedented blunder.”
Northern & Shell has requested to include these documents as part of its evidence in the ongoing legal case.
While the UKGC acknowledged that most of the disclosed documents could be used, they sought to exclude 128 files which included sensitive strategic matters such as bid assessments and correspondence with the Department for Culture, Media, and Sport.
Judge Jefford ruled that certain categories of documents, particularly those marked as legally privileged, could not be used. However, she allowed the inclusion of documents that did not explicitly contain legal content.
Northern & Shell seeks a judicial declaration stating that the Gambling Commission acted unlawfully regarding the lottery tender and is pushing for £200 million in financial compensation.
Mediation Efforts Fail
Northern & Shell rejected a settlement offer from the UKGC last December, which could have been valued at around £10 million, according to reports.
The Gambling Commission was eager to settle to prevent further delays in transferring control of the National Lottery from previous operator Camelot to Allwyn. The ongoing litigation has already impacted funds allocated for various charitable projects.
The case is scheduled to go to trial in October, with the UKGC warning that any financial compensation awarded to Northern & Shell might reduce the funds available for these community causes.
